Please take time to read these terms and conditions (our ‘Terms’) before purchasing your Vouchers on  www.intotheblue.co.uk   (our ‘Website’ as these are the Terms on which you (‘You’, ‘Your’) will be purchasing Vouchers with Activity Gift Vouchers Ltd (‘Us’ ‘Our’ and ‘We’, t/a ‘Into the Blue’) for activities supplied by the relevant supplier of that activity (the ‘Supplier’). Into the Blue act solely as an agent on behalf of the Suppliers of activities listed and sold on Our Website to You. Into the Blue sell and issue redeemable multipurpose face value credit vouchers (‘Vouchers’) on behalf of our Suppliers.

Each Voucher sets out a suggested activity, however, if the user prefers, the Voucher can be used for an alternative activity by using Our online exchange system; alternatively, please contact Us by emailing Us at customerservices@intotheblue.co.uk.

 
 
 

Voucher Booking

By purchasing a Voucher on  www.intotheblue.co.uk   You enter into an agreement with Us. By booking an activity with the Supplier You then enter into an agreement with that Supplier for the supply of the relevant activity and will be subject to the Suppliers’ terms and conditions, together with these Terms. The Supplier has their own terms and conditions which You should check carefully to ensure You are compliant with them. It is the responsibility of the Voucher holder to ensure that the activity is booked within season bearing in mind that this may end before the expiry date of the Voucher. Once You have booked Your activity, You are bound by the terms and conditions of the respective Supplier of that activity. You must book and take your experience before the expiry date of the voucher.
 
 
 

Availability

No guarantee can be made as to availability of the activity on any particular day. We advise that the Voucher holder books as soon as possible before the preferred date. Many activities are seasonal; approximate details of availability may be viewed online when You register Your Voucher however specific dates will be provided by the Supplier when You book. Should an activity become unavailable or a particular location become unavailable We will endeavour to inform You of this as soon as possible and offer an exchange or a refund to the purchaser of the Voucher. This will be the limit of Our liability and We will not be liable for any other costs incurred by the Voucher holder such as travel or accommodation.
 
 
 

Pricing And Price Promise

Please note that the prices and offers advertised on the Website may be changed from time to time. In the event of an activity being issued or processed at an incorrect price, We will advise the Voucher holder and offer either a full refund or for them to pay/receive the balance in price to their account. If the purchaser of a Voucher finds the identical product on sale from another multi-experience agent at a lower price within seven days of the purchase date (excluding sales, special offers, time and date bookings and other promotions), Into the Blue will refund You 150% of the difference, up to a maximum value of £50.
 
 
 

Discounts And Promotions

We reserve the right to limit the use of discount codes to certain activities, price ranges and times. Most discounts and promotion codes have limitations; We are not always able to display the full terms of such discounts on smaller advertisements. Most discount codes apply to the whole checkout basket total on items up to £250 in value and only one promotional code may be used at any time. You will be advised in the basket page if Your discount code may be applied to Your purchase.  Click here   for a list of products excluded from discount codes. Please contact Us if You have any questions in relation to discount codes. When a discount code has been used for the original purchase, the value of the credit will be based on the amount paid, not on the pre-discount value of the Voucher. Please note that all promotional codes are for new online orders only and cannot be used in conjunction with an exchange or existing Voucher.
 
 
 

Security Of Payment

Our Vouchers are not covered by the Financial Services Compensation Scheme. In the unlikely event of Into the Blue becoming insolvent, some or all of the credit on the Vouchers and/or tokens may not be available to spend. However, if You made Your purchase using a Visa Credit or Debit card or a MasterCard Credit card, you may be able to make a claim under the protection offered by Visa or MasterCard; please read the terms and conditions of Your Visa Credit or Debit card or a MasterCard Credit card.
 
 
 

Restrictions

Most activities have restrictions which may include limits on height, weight and age. Please check all the information provided to ensure that the activity is suitable for the recipient. If You or the participant have any questions please check with the Supplier before booking Your activity. Some driving activities require the user to hold a full driving licence; please check before purchasing a gift Voucher. The participant will need to be agile enough to get in and out of any equipment in use and must be medically fit enough for the particular activity. If the user has any doubts about medical fitness, they should consult their doctor and also speak with the Supplier if in doubt.
 
 
 

Experience Descriptions

Whilst every effort is made to provide accurate details of the activities available, the duration of such activities given on the website should be used as guidelines only. Where Vouchers can be redeemed at multiple locations, exact durations, itineraries, equipment and guest numbers cannot be given as these may vary from location to location. Into the Blue cannot be held liable for delays or equipment breakdowns and the responsibility of this lies solely with the Supplier for that activity. We endeavour to give accurate and detailed information about every activity, however, there may be changes in the exact arrangements on the day or during the lifetime of the Voucher. These descriptions should therefore be taken as a guide only and do not form part of the contract. In the event of an incomplete activity and no satisfactory alternative being supplied to the Voucher holder by the Supplier, the maximum compensation available is limited to the net cost of the activity, to be decided by Into the Blue and/or the Supplier. Photographs used are illustrative and not necessarily of the actual equipment in use at any particular location. For further information, please contact the relevant Supplier for Your chosen activity.
 
 
 

Distances And Locations

Voucher Life

Vouchers are usually valid for 12 months from the date of purchase (unless otherwise stated) and shall become invalid on the expiry date. The expiry date is set out on the Voucher. Vouchers may be extended for a further 12 months on payment of an admin fee of £10 for vouchers with a value of less than £100 and £20 for vouchers valued over £100 plus any increase that may have taken place for that activity since the original date of purchase. Please note that some Vouchers cannot be extended; this will be stated on the Voucher. PLEASE NOTE: You must book and take your experience before the expiry date of the voucher.
 
 
 

Cancellation

Waiting time may be necessary with all activities, especially as some are weather dependent. There is also the possibility of short notice cancellation due to reasons such as the weather, mechanical problems, staffing issues or other unforeseen circumstances beyond the Supplier’s control. If the activity is cancelled, the user should simply re-book with the respective Supplier. Into the Blue will not be liable for any costs such as travel or accommodation incurred by the participant in such circumstances. Once booked, if You cancel without giving the required notice under the terms and conditions of the Supplier for that activity, Your activity may be forfeited. Please check the cancellation terms and conditions of the Supplier carefully when booking.
 
 
 

Exchanges

Our Vouchers can be exchanged free of charge by using the ‘Exchange your Voucher’ link on our homepage. Vouchers cannot be exchanged if they have expired or have already been booked with a Supplier. Exchanged Vouchers will have the same expiry date as the original Voucher; extensions are available for an additional fee (see above). If the Voucher holder exchanges their activity for a more expensive activity, the Voucher holder will need to pay the difference at the time of exchange. If the chosen alternative is less expensive We will issue an e-voucher for the balance to put towards a future purchase. Promotional discount codes cannot be applied to an exchange or token redemption. If a discount code has been used for the original purchase, the value of the credit will be based on the amount paid, not on the pre-discounted value of the Voucher. Physical gifts, gift tins and competition prizes cannot be exchanged.
 
 
 

Refunds

Refunds can be requested within 14 days of purchase unless the activity has already been booked with the Supplier. Refunds after this period will be at Our sole discretion and will be subject to a £20 or 20% (whichever is greater) fee. Note that refunds can only be made to the purchaser. Refunds will not be made to a Voucher holder who is not the purchaser, or any third party. Physical Gifts and Gift Tins can only be returned if all contents are present and the plastic wallets are intact. Should an activity or specific location become unavailable We reserve the right to provide an exchange or a full refund to the original purchaser, this will be the limit of Our liability and We will not be responsible for any costs incurred such as travel or accommodation.
 
 
 

Limitation Of Our Liability & Suppliers’ Liability

As clearly stated above, by booking Your activity You will be subject to the relevant Suppliers terms and conditions for the supply of that activity, including restrictions and cancellation. Into the Blue are not providers of activities, experiences, Suppliers of aircraft, providers of carriage by air or Suppliers of any vehicle or equipment used in the activities. Whilst Into the Blue endeavour to select experienced and qualified Suppliers We are not responsible and cannot be held liable for the safety standards or performance of any Supplier or any loss or damage suffered by You whilst participating in the activity for which the Supplier is solely responsible.
 
 
 

Indemnity, Waivers And Cancellation Insurance

Activities may require the completion of an indemnity form before participation. Please read the Supplier’s terms and conditions very carefully in relation to this. Some driving Suppliers may hold drivers liable for a fixed amount of costs should they damage the vehicle whilst driving. In these instances most Suppliers offer optional insurance (‘Damage Waiver Insurance’) where, for an additional fee (usually around £25 please see the Supplier’s terms and conditions) Your liability for vehicle damage costs is removed. Some Suppliers also offer cancellation insurance. The purchase of any insurance offered by the Supplier is optional and is in addition to the Public Liability Insurance already held by the Supplier. You may also be required to sign a Waiver of Liability with the Supplier in relation to any risks of injury. You should read the Supplier’s terms and conditions and your personal insurance policy (if any) very carefully in relation.
 
 
 

Safety And Insurance

By taking part in an experience You accept the existence of an element of personal risk. Personal insurance policies vary in their coverage and may exclude Your chosen activity. It is advisable to check with the Supplier and Your insurance company in advance. Activity Suppliers arrange their own liability insurance. Some activities may require You to sign a disclaimer before taking part so please read this information carefully. Most activities will rely on participants following instructions to comply with health and safety, please follow these carefully. All Suppliers reserve the right to withdraw or end an experience if participants are deemed to be a danger to themselves or others. Experience Suppliers arrange their own liability insurance which will provide insurance for participants in the case of negligence on behalf of that Supplier.
 
 
 

Spectators

Many Suppliers permit You to bring spectators to watch You participate in Your chosen activity. Whilst Into the Blue endeavour to provide information regarding spectators You must inform the relevant Supplier when booking Your activity if You would like to bring spectators. Some Suppliers may charge a small fee; some may not permit any spectators. All spectators are expected to adhere to the terms and conditions of the relevant Supplier, including for example - alcohol consumption and behaviour. Postage And Evouchers

Printed Vouchers are sent by First Class Royal Mail (or Special Delivery where selected) We cannot be held liable for any cost or inconvenience caused due to delayed or lost mail. E-Vouchers are sent in PDF format by email immediately after purchase and are not subject to postage and packing fees. We advise that You print and take a copy of the e-Voucher with You on the day of Your activity. E-Vouchers can be added to a physical order for no extra charge. If, after ordering an e-Voucher You decide You would like a physical Voucher or gift packaging, please contact us on customerservices@intotheblue.co.uk and we’ll advise You of options and any admin fees.
 
 
 

Physical Products And Gift Tins

Gift Tins and physical products may be shipped directly from the Supplier. They cannot be exchanged online for other activities. Physical products can be returned only if all contents are present and plastic wallets are intact. Delivery of these items is limited to UK addresses only. Orders made before 1.30pm Monday to Friday will be posted the same day. Gift Box upgrades are not available for physical products.
 
 
 

Delivery

Gift Vouchers are despatched by first class Royal Mail or optional Special Delivery. We will not be liable for any cost or loss or inconvenience suffered due to delayed or lost mail.
 
 
 

Personal Data

The Data Protection Act 1998 requires Us to inform You that We hold information You provide on Our database. You acknowledge that You will be providing Us with Your personal information when making bookings for activities and You permit Us to provide these to the Supplier with whom You book your activity/activities with. We use the information primarily for the provision of providing You with activities from the relevant Supplier to You and for related purposes, including updating and keeping Our records up to date. Our use of that information is subject to Your instructions and the Data Protection Act 1998.
 
 
 

Children's Issues

The Web Site is not directed to children under thirteen (13) years of age, and children under such age must not use the web site or services offered on it to submit any individually identifiable information about themselves.

The easiest way of resolving a complaint is to address them on the day with the Supplier of the relevant activity. If Your complaint cannot be resolved on the day, please send details to us at office@intotheblue.co.uk, including your Voucher number, date of the activity and who You spoke to on the day.
 
 
 

Third Party Rights

These Terms constitute the contractual Terms between You and Into the Blue, and does not create any right enforceable by any person under the Contracts (Rights of Third Parties) Act 1999, but this does not affect any right or remedy of a third party which exists or is available apart from under that Act.
 
 
 

Applicable Law

These Terms shall be governed by and construed in accordance with English law. The Courts of England shall have exclusive jurisdiction in relation to any claim, dispute or difference concerning any matter arising from these Terms.
